How Maternity Leave Is Processed: Legal Nuances

To exercise the right to maternity leave, a woman must apply to her employer with a medical certificate of incapacity for work, which is issued by a doctor at the 30th week of pregnancy. Based on this document, an order for leave due to pregnancy and childbirth is issued, after which the Social Insurance Fund makes the corresponding payments.

The second part — leave to care for a child — can be taken not only by the mother but also by the father, grandmother, or another family member. It is important that during this period the workplace is retained, and the state pays a monthly allowance.

According to the law, a woman receives:

  • 70 days before childbirth and 56 days after (or 70 after — in case of complicated childbirth)
  • Leave to care for a child up to 3 years old, with the possibility of extension up to 6 years — for medical reasons

But behind these numbers lies something more than just terms. Because maternity leave is not “vacation,” as is sometimes mistakenly thought. It is a time when a woman simultaneously recovers physically and learns to live in a new reality: without sleep, without weekends, with full responsibility for a new life.

During maternity leave, several types of social support are provided. The most important of them:

  • Benefit for pregnancy and childbirth — a one-time payment calculated based on the average income for the last 12 months

  • Benefit for child care — currently absent as a separate category, but a woman has the right to receive assistance as a low-income person if the family’s income is low

These payments are not a “gift” from the state, but a form of compensation for the period when a woman cannot work physically. And although their size often does not cover real expenses, they play an important role in the psychological sense of support.

Who Else Can Use Maternity Leave

Maternity leave is not only about women. In the modern world, the number of cases when a man takes child care leave is increasing. This is an important step toward overcoming gender stereotypes. In addition, if the mother cannot take care of the child (for example, due to illness), the leave can be taken by grandmothers, grandfathers, or even guardians.

Such an approach shows: the main thing is not formality, but care for the child. And the state must be flexible enough to support this particular value.

Problems and Challenges: Why Maternity Leave Is Not Always Protection

Despite legislative guarantees, in Ukraine, women often face discrimination in the workplace precisely because they have small children. Some employers unofficially perceive a “future maternity leave” as a threat to business, avoiding hiring women of childbearing age.

In addition, the amount of social assistance does not always correspond to the real costs of a child, which forces many mothers to return to work much earlier. All this requires deeper reforms — both in legislation and in the cultural perception of motherhood.

For context, it is worth remembering how the maternity leave system works in Europe. For example:

  • In Sweden, parents have 480 days of paid leave, which can be shared between them
  • In Germany, Elterngeld operates — a payment system amounting to 67% of the salary
  • In Poland, 52 weeks of paid leave are provided for the mother

These examples show that maternity leave is not only about a woman and a child but about the values of society as a whole. How ready we are to support those who literally create the future.

When we say “maternity leave,” we mean something more than a formal break from work. It is a period of life when the greatest emotional, physical, and social changes occur. It is a time when the support of the state, the employer, and the family should be at its maximum.

In conclusion, it is important to emphasize: maternity leave is not a concession or a privilege. It is a basic right that must be protected not only by law but also by respect in society. And only then can we say that we truly care about life — from the very first breath.
